It seems <html> element is like a pseudo window element or view container element?

With these it helps First, if here in Stack Overflow's page you get the .offsetHeight and getComputedStyle()['height'] to be the size of the viewport, it is because there is a rule stating html { height: 100%; }.
Without this rule, you'd have it the same size as the body:
code :
console.log( "height:auto" );
console.log( "offsetHeight", document.documentElement.offsetHeight );
document.documentElement.classList.add( "SO" );
console.log( "height:100%" );
console.log( "offsetHeight", document.documentElement.offsetHeight );
body {
  height: 1000vh;
}
html.SO {
  height: 100%;
}
console.log( document.scrollingElement === document.documentElement );

I wish this helpful for you Like I posted on the comments, it wasn't my code but the statistic code by Nielsen that was messing with the JS.
I removed it and it worked. Then I ended up moving it to the head tag and it worked.

Can I use the pseudo element to insert html element?

like below fixes the issue Unfortunately, you can't do that with CSS. But it's possible in JavaScript, for instance with jQuery .append(); method.
code :
// Add Baz to .myList
$( ".myList" ).append($("<li>Baz</li>"));
<!-- jQuery -->
<script src="https://ajax.googleapis.com/ajax/libs/jquery/2.1.1/jquery.min.js"></script>

<ul class="myList">
  <li>Foo</li>
  <li>Bar</li>
</ul>

create a border effect around element when there is a pseudo element covering or hiding part of the element

like below fixes the issue I have an angled cornered tab whose angles were create by using :after and :before. I would like to get a border around the tabs. Obviously if i just do border: 1px solid ; for the li it will create a box around the tab and not around the shape. How would you get it done? here's what I was working with. , I would probably use squares instead of triangles and rotate them:
code :
li{
  display: inline-block;
  background: lightgreen;
  padding: .4em .9em;
  position: relative;
  border: 1px solid black;
}
li:before, li:after{
  content: "";
  display: block;
  position: absolute;
  font-size:0;
  background: white;
  border-bottom: 1px solid black;
}
li:before{
  width: 10px;
  height: 10px;
  top: -5px;
  left: -5px;
  -webkit-transform: rotate(-45deg);
  -moz-transform: rotate(-45deg);
  transform: rotate(-45deg);
}
li:after{
  width: 20px;
  height: 20px;
  top: -10px;
  right: -10px;
  -webkit-transform: rotate(45deg);
  -moz-transform: rotate(45deg);
  transform: rotate(45deg);
}

How to determine if HTML element has pseudo element?

To fix this issue What exactly is causing problems with your existing solution?
This method of walking through elements:
code :
var allElements = document.getElementsByTagName("*");
for (var i = allElements.length; i--;) {
  //var usedStyle = window.getComputedStyle(allElements[i], ":before/:after");
  ...
}

Absolutely positioned pseudo element acts as block element in flex container in IE

With these it helps IE is known to have a lot of flex bugs. Here instead of justify-content: space-between you can use margin-right: auto on the first p element to get the same effect.
See demo below and updated fiddle:
code :
nav {
  display: flex;
  justify-content: space-between;
}

nav p:first-child {
  margin-right: auto;
}

nav:before {
  content: "";
  position: absolute;
  width: 10px;
  height: 10px;
  background-color: orange;
}
<nav>
  <p>LEFT</p>
  <p>RIGHT</p>
</nav>
